By accessing or using ThumbnailInsight ("the Service") at ThumbnailInsight.com, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the Service. These terms apply to all visitors, users, and others who access the Service.
2 Description of Service
ThumbnailInsight provides a free, browser-based tool for previewing YouTube video thumbnails across multiple simulated layouts and for analysing thumbnails against CTR-related metrics. The Service is provided for informational and design-preview purposes. ThumbnailInsight is an independent tool and is not affiliated with, endorsed by, or operated by YouTube or Google LLC.
Preview layouts are approximations based on YouTube's interface at the time of development. YouTube's interface may change without notice, which may affect the accuracy of previews.
3 Acceptable use
The Service is free to use for lawful purposes. You agree not to:
- Use the Service to test or distribute content that is unlawful, harmful, defamatory, obscene, or infringes on the rights of others
- Attempt to reverse-engineer, scrape, or automate requests to the Service in a way that places unreasonable load on our infrastructure
- Use the Service to process images you do not have the legal right to use
- Attempt to circumvent any technical limitations or security measures of the Service
- Impersonate ThumbnailInsight or claim affiliation with our Service in any misleading way
- Use the Service in any way that violates applicable local, national, or international laws or regulations
4 Intellectual property
The Service, including its design, source code, text, graphics, and user interface, is owned by ThumbnailInsight and is protected by applicable copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service without prior written consent.
You retain full ownership of any thumbnail images you test using the Service. We claim no rights whatsoever over your creative work.
5 Privacy and image processing
As described in our Privacy Policy, all image processing occurs locally in your browser. We do not receive, store, or process your thumbnail images on our servers. You are solely responsible for ensuring you have the legal right to use any images you test through the Service.
6 Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Thumbnail previews will exactly match how YouTube renders thumbnails at any point in time, as YouTube's interface may change without notice
- Any errors in the Service will be corrected
7 Limitation of liability
To the maximum extent permitted by applicable law, ThumbnailInsight, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to:
- Loss of revenue or profits
- Loss of data or business information
- Loss of goodwill or reputation
- Any other commercial or economic loss
In no event shall our total liability to you for all claims arising from the Service exceed the amount you paid to use the Service in the past 12 months (which for free users is zero).
8 Third-party services
The Service uses Google Fonts for typography. Your use of the Service is also subject to Google's Privacy Policy. We are not responsible for the practices of any third-party services linked to or used by the Service.
9 Changes to the Service and terms
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We also reserve the right to update these Terms and Conditions at any time. Material changes will be reflected in the "Last updated" date at the top of this page. Continued use of the Service after changes have been posted constitutes your acceptance of the revised terms.
10 Governing law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the United States.
